How will financial arrangements be sorted out?
Our family law solicitors have essentially three parts to their job when considering someone’s financial position.
Firstly, we help you identify and value your assets. Are all the assets matrimonial or are some inherited or pre-acquired?
Do you both agree the valuation of each asset? This can be harder than it seems when it comes to a business or a pension.
Secondly, our family law solicitors help you reach a settlement. To do this they may advise you, after careful consultation, to use one of the following (this is not an exhaustive list):
- Family Mediation
- Collaborative Law
- One Lawyer One Couple
- Round Table Approach
- A Private Financial Dispute Resolution Hearing
- Early Neutral Evaluation
- Arbitration
- Solicitor-Led Negotiations
- Court Proceedings
Finally, our family law solicitors will draft the court order that details your agreement and will make sure you understand your commitments and the future consequences of that agreement.
They will deal with the court and ensure it becomes an enforceable order. This order is called a Financial Remedy Order. If it is agreed to voluntarily it is often referred to as a “Consent Order”.
