GOOD DIVORCE WEEK 30 November – 4 December 2020
Kay & Pascoe LLP are proud to be taking part in Good Divorce Week.
As of 2013 and the implementation of the Legal Aid, Sentencing and Punishment of Offenders Act 2012 (LASPO) there is now very little Legal Aid available and it is only available for those people who find themselves in situations of domestic abuse or where there are child protection issues; whatever your financial situation.
This leaves many people on low to middle incomes who are hesitant about taking legal advice.
The aim of the scheme next week is to ensure that anyone who has a Family Law query can seek some free advice from a Family Lawyer who is a Resolution Member and has therefore signed up to Resolution’s Code of Practice.
This code states that all Resolution Members will, amongst other things,-
- Reduce or manage any conflict
- Listen to and treat everyone with respect and without judgement
- Support and encourage families to put the best interests of the children first
While Mr Justice Pepperall has this week ruled that for those who need legal aid because of domestic abuse, their locked-up capital cannot be taken into account in considering their financial entitlement. However this still doesn’t change the situation for most people.
